Terms of Service

These terms are an agreement between you and the operator of CMD-OS (“we”, “us”) for your use of CMD-OS at cmd-os.app (the “Service”). By creating an account you accept them, together with our Acceptable Use Policy and, where you store other people's personal data, our Data Processing Addendum. Our Privacy Policy explains how we handle personal data. If you accept on behalf of a business, you confirm you can bind it, and “you” means that business.
1. Your account
- You must be at least 16 and give accurate sign-up details.
- One person per account. Keep your password safe; you are responsible for activity under your account.
- Tell us straight away at the contact address on our Contact page if you think your account has been compromised.
2. Subscription and payment
- CMD-OS has three plans: Solo at $19 per month or $190 per year; Creator at $39 per month or $390 per year; Studio at $79 per month or $790 per year. Each is billed in advance through Stripe. Prices are in US dollars; taxes are added where the law requires.
- Your subscription renews automatically each month or year, as you chose, until you cancel.
- Each plan includes a number of AI runs per billing period (on annual plans, per month). Unused runs, and runs from a $10 top-up, expire at the end of the period. When they run out, AI generation pauses; the rest of the service keeps working.
- The first 100 Solo subscriptions keep the $19 monthly price for as long as they stay subscribed to Solo. Cancelling or changing plan ends it.
- We may change the price with at least 30 days' notice by email. A new price applies from your next billing period after the notice; you can cancel before then.
- If a payment fails, we will retry and may pause access until it succeeds. Your data is not deleted.
3. Cancelling and refunds
- Cancel any time from Settings → Billing (the Stripe customer portal). You keep access until the end of the period you have paid for, and aren't charged again.
- Payments are non-refundable except where these terms or the law say otherwise.
- Consumers in the EU and UK have a 14-day right to withdraw from the contract after it is made. Because the Service starts immediately at your request, if you withdraw within those 14 days we refund the payment minus a proportionate amount for the days you already used. To withdraw, cancel in the billing portal and email the contact address on our Contact page within 14 days. This right does not apply if you use CMD-OS for your trade, business or profession.
4. Your content
- Everything you put in CMD-OS stays yours. You give us permission to host, copy, process and display it only as needed to run the Service for you, including sending it to services and AI apps you choose to connect.
- You are responsible for your content and for having the right to store it — including any personal data of your clients, contacts and leads, for which you are the controller under our DPA.
- We don't use your content to train AI models, and we don't look at it except to provide support you ask for, keep the Service secure, or comply with the law.
- You can export all of your data at any time from Settings → Account & data.
5. Connected services and AI
- When you connect Google, GitHub, a mailbox or an AI app, you authorise us to exchange data with it on your behalf. Those services are governed by their own terms; we aren't responsible for them.
- Agent access lets AI apps you approve read and update your workspace. You are responsible for which apps you approve and what you ask them to do; you can revoke any of them at any time in Settings → Integrations.
- AI output can be wrong. Check anything that matters — such as an invoice amount or a message to a client — before relying on it.
6. Acceptable use
Use the Service lawfully and within our Acceptable Use Policy. In particular, don't use it to send spam, store content you have no right to, or attack or overload the Service or anyone else.
7. The Service
- We work to keep CMD-OS available and secure, but can't promise it will be uninterrupted or error-free.
- We may improve, change or remove features. If we remove something material you rely on, we will give you reasonable notice and, where you have prepaid for it, a pro-rata refund if you cancel because of it.
8. Suspension and termination
- You can delete your account at any time in Settings → Account & data.
- We may suspend or close an account that seriously or repeatedly breaks these terms, or where the law requires. Unless it would be unlawful or put others at risk, we will tell you first and give you a chance to export your data.
- When an account is deleted, its data is removed from our live systems immediately and from backups within 30 days, except records we must keep by law (such as invoices).
9. Warranties and liability
- The Service is provided “as is” and “as available”. To the extent the law allows, we disclaim implied warranties such as merchantability and fitness for a particular purpose.
- To the extent the law allows, neither of us is liable for indirect or consequential loss, or for lost profits, revenue or data, and our total liability for any claim is limited to the amount you paid us in the 12 months before it arose.
- Nothing in these terms limits liability that can't legally be limited, such as for death or personal injury caused by negligence, or for fraud. If you are a consumer, you keep all your statutory rights.
- If you use the Service for business, you will cover our reasonable costs from third-party claims arising from your content or your breach of these terms.
10. General
- We may update these terms. We will email you at least 30 days before a material change takes effect; if you don't agree, you can cancel before then.
- These terms are governed by the laws of the jurisdiction where we are established. If you are a consumer in the EU or UK, you also keep the protection of the mandatory laws of the country where you live and may bring proceedings there.
- If part of these terms is unenforceable, the rest still applies. Not enforcing a term isn't a waiver of it.
- These terms, with the policies they link to, are the whole agreement between us about the Service.
